Website Terms of Service & Free Trial Terms

1. About These Terms

These Terms of Service (“Terms”) govern your access to and use of the Modern British English website, online English language courses, educational materials, free trials, paid programmes, and any related community spaces (together, the “Courses” and “Services”), whether accessed as a guest or as a registered user.

The Services are operated by Modern British English Ltd (“we”, “us”, “Modern British English”).

2. Eligibility & Access

Access to and use of the Services is strictly limited to individuals who:

• Are 16 years of age or older

• Can legally form a binding contract

• Provide accurate and complete registration information

• Comply with these Terms, all applicable laws, and our policies

Any access or use by individuals under the age of 16 is strictly prohibited.

You must not share your login details, allow account access by others, or distribute Course content. Any such misuse may result in immediate suspension or termination without refund.

3. Free Trial (7 Days)

3.1 Free Trial Access

Modern British English may offer a 7-day free trial to new customers only. The trial begins when you register and accept these Terms and ends automatically after seven (7) consecutive calendar days.

3.2 Trial Limitations

During the Free Trial:

• Access to Courses, lessons, features, feedback, or live elements may be limited

• No guarantees of results, progress, or outcomes apply

• Service level commitments do not apply

3.3 Educational Use

The Free Trial is provided for educational and informational purposes only. We make no representations regarding fluency, pronunciation improvement, career outcomes, or language mastery during the trial period.

4. Guest Pass (One Friend Only)

4.1 Guest Pass Allowance

Each Free Trial user may invite one (1) guest to access the Free Trial at no cost (“Guest Pass”).

4.2 Guest Pass Restrictions

The Guest Pass:

• Is strictly limited to one individual

• Is non-transferable

• May not be shared, resold, reassigned, or passed on

• May not be used to invite additional users

• Ends at the same time as the original Free Trial

4.3 Misuse

We reserve the right to revoke Guest Pass access or terminate both accounts if we suspect account sharing, abuse, or circumvention of these Terms.

5. Purchasing Courses & Payment Terms

5.1 Registration

To purchase a Course, you must create an online account and provide accurate, up-to-date information.

5.2 Pricing

All Course fees are displayed on the website prior to purchase. Fees are shown in the stated currency and include applicable taxes unless otherwise indicated.

5.3 Payment

Payment is taken at the point of purchase or upon automatic conversion from a Free Trial where billing details have been provided.

By submitting payment details, you authorise us (or our payment providers) to charge the applicable fees.

5.4 Automatic Conversion

If you provide billing information during a Free Trial, your account may automatically convert to a paid programme at the end of the trial unless cancelled beforehand.

5.5 Failed Payments

If a payment fails, access may be suspended until payment is successfully completed.

6. Cancellation & Refunds

6.1 Cooling-Off Period

Where applicable under UK/EU consumer law, you may cancel a paid Course within 14 days of purchase unless:

• You have accessed a substantial portion of the digital content, or

• You have expressly consented to immediate access

6.2 Refund Method

Refunds will be issued to the original payment method only.

6.3 Free Trial

No refunds apply to Free Trial access unless required by law.

7. Course Content & Licence

We grant you a non-exclusive, non-transferable, revocable licence to access Course content for personal, non-commercial use only.

You may not:

• Copy, reproduce, share, resell, or distribute content

• Create derivative works

• Share login credentials or Course materials

Access may be revoked for breach without refund.

8. Modifications to Courses

We may update, improve, or modify Course content at any time. Access to updates applies only to the Course purchased or accessed.

9. Technical Support & Availability

We use reasonable efforts to keep the Services available but do not guarantee uninterrupted or error-free access.

We are not responsible for:

• Internet outages

• Device compatibility issues

• Third-party platform failures

• Browser or software updates

10. Intellectual Property

All Course content, branding, designs, videos, text, exercises, and materials are protected by intellectual property laws and remain our property or that of our licensors.

Unauthorised use may result in termination and legal action.

11. Limitation of Liability

Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence.

To the maximum extent permitted by law, we are not liable for:

• Loss of income or business

• Loss of data

• Indirect or consequential losses

Our total liability shall not exceed the amount paid by you for the relevant Course.

12. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws.

13. General

• These Terms constitute the entire agreement between you and us

• We may update these Terms from time to time

• English law governs these Terms

• The courts of England and Wales have exclusive jurisdiction
